CONTRACT & TERMS AND CONDITIONS OF HIRE FOR HOME STAGING

HIRER
WHANGAREI HOMESTAGERS AND INTERIOR DESIGN LIMITED




HOME STAGING PROPERTY LOCATION




This is a contract for the hire of furniture, accessories and art (“ the Goods”) together with a provision of labour to place and style these items at the Property collectively known as ‘Home staging’ Whangarei Homestagers agrees to hire the Goods to the Hirer with effect from date of contract (“ the Commencement Date”)




COMMENCEMENT DATE: (Day of goods are installed)
END OF INITIAL HIRE PERIOD: (6 weeks from day of goods installed)




1. INITIAL HIRE PERIOD
The initial hire period is five weeks with a complimentary sixth week.
The hire period will automatically extend after the expiry date unless written notice is received by Whangarei Homestagers seven days prior to the end of the initial hire period or any subsequent extended period.
       
2. INITIAL HIRE FEE                                                                   
The Hirer will pay Whangarei Homestagers the Initial Hire Fee which must be paid  in full at least 48 hours in advance of Commencement Date.
No refund of the initial hire fee will be given should the Hirer request cancellation/removal during the initial hire period.


3. EXTENSION OF HIRE PERIOD 
If at the end of the initial hire period the Hirer does not notify Whangarei Homestagers the agreement will be automatically renewed in periods of one week at the same weekly rate as the initial hire fee (20% of initial hire fee)
Five business days notice must be given to Whangarei Homestagers when the goods are no longer required by the Hirer during the initial hire period.


4. PAYMENT DEFAULT FEE
In the event that payment of the hire fee is not made on the due date, Whangarei Homestagers reserves the right to charge interest at the rate of 1.0% plus GST per month on the outstanding balance due, from the due date of the payment.
Should Whangarei Homestagers engage an agent for the collection of items owned by Whangarei Homestagers or outstanding debts, the Hirer agrees to pay for the cost of collection, including solicitor’s fees that may be incurred in addition to the outstanding debt.


5. HIRER OBLIGATIONS
The Hirer is responsible for the security of the property to ensure all internal and external doors and windows are to be locked.
The Hirer is responsible to ensure curtains/drapes to be drawn closed to prevent any sun damage of Goods.
The Hirer will also ensure that utilities such as electricity and water are available for use at the property throughout works and at no cost to Whangarei Homestagers.


6. LOSS OR DAMAGES OF THE GOODS
The Hirer agrees that they shall be responsible for any loss or damage to the Goods from any cause at all times during the Rental Period until the goods are returned to Whangarei Homestagers.
The Hirer is required to notify Whangarei Homestagers of any loss or damage to the Goods within 24 hours. In this case the Hirer will be liable to pay Whangarei Homestagers to the value of the said goods such value not to exceed the retail price of the said goods at the commencement of the initial hire period.


7. REMOVAL OF GOODS
Five business days notice must be given to Whangarei Homestagers when the goods are no longer required.
The Hirer agrees not to remove or allow any other person to remove the Goods from the premises where the Goods are to be kept, as set out in the agreement.


8. RIGHT OF ACCESS
The Hirer agrees to provide Whangarei Homestagers staff reasonable access to the premises where the Goods are kept, for the purpose of delivery, inspection, repair and collection. The Hirer further agrees to pay any costs of any action that Whangarei Homestagers deems necessary to obtain back the Goods.


9. USE OF GOODS 
The Hirer agrees that the goods Supplied by Whangarei Homestagers are for display use only. Whangarei Homestagers may during the term of contract, change items at their discretion substituting changed items with similar or more compatible items.


10. PHOTOGRAPHS AND PROMOTION
The Hirer agrees that Whangarei Homestagers may take photographs of the premises with and without staged items for its promotional purposes.
Whangarei Homestagers grants the Hirer authority to take photos of the staged items in all promotions of the premises.
The Hirer grants Whangarei Homestagers right to use of photographs of supplied goods in images for promotional purposes.


11. INSURANCE
Whangarei Homestagers insures goods whilst in transit and once placed at the property against loss resulting from damage, theft and burglary. 
The insurance policy is to the value of $10,000 inclusive of gst and up to $2,500 for any one item. The Hirer is liable for the equivalent amount of the excess: $2,500 inclusive of gst. The Hirer is also liable for the value of any stock loss exceeding $10,000 inclusive gst. Check with Whangarei Homestagers to determine the value of the stock held at each job. All amounts payable relating to the claim must be settled within 5 business days or interest and penalties will accrue.The Hirer and Hirer’s agents must report any loss immediately to Whangarei Homestagers and undertake all reporting to the Police where theft or damage and loss is malicious and do anything else as may be required to facilitate the Insurance Claim. 
OR, all goods while at the address can be insured by the Hirer.


12. SCOPE OF WORK
Whangarei Homestagers shall include in the contract price delivery and pick up of goods. Placement of goods in the delivery address shall be at Whangarei Homestagers discretion. A minimum of $200.00 delivery fee will be charged for any additional furniture and/ or soft furnishing hire changes requested by Hirer.


13.  LIABILITY
Hanging of Artwork, Mirrors and other items is a part of our contracted services. It is agreed that any damage arising from installation of all furniture, furnishings, artwork and mirrors remains the Hirer’s responsibility to rectify or restore after the items have been removed from by Whangarei Homestagers including, but not limited to, holes left from nails, screws or picture hooks left from removal of pictures, art or mirrors, blemishes, discolouration, rust from outdoor furniture left outside, carpet indentation and scratches.


14. CANCELLATION
The Hirer authorises and directs Whangarei Homestagers to obtain and pass on Cancellation of this agreement prior to installation of the goods will attract an administration fee equal to 20% of the initial hire fee – i.e. a refund of 80% will be given. No refund of the initial hire fee will be given should the Hirer request cancellation/removal during the initial hire period.
If cancellation happens up to 48 hrs prior a 50% fee will be charged.


15. CREDIT REPORTING
The Hirer authorises and directs Whangarei Homestagers to obtain and pass on any information concerning the credit or business standing of the Hirer from any organisation or agency whatever, and directs any such person to supply such information to Whangarei Homestagers. Furthermore, authorisation is extended to Credit Agencies to store and have such information available to the Agency and other subscribers using credit reporting services provided by Credit Agencies via their respective databases. The Hirer is entitled to have access to and to request correction of personal information concerning the Hirer obtained by Whangarei Homestagers.


16. SUITABILITY
Whangarei Homestagers shall not be liable for any consequential loss or losses due to any failure of the Goods.
